Billbooks Affiliate Program Terms & Conditions
As an authorized affiliate (Affiliate) program, the terms and conditions contained in this Agreement represent the whole agreement and understanding between Billbooks.com and the individual or entity who participates in this affiliate program. Please read the entire Agreement carefully before registering and promoting Billbooks as an Affiliate.
Your participation in the Program is solely to legally advertise our online software to receive a commission on memberships and products purchased by individuals referred to Billbooks by your own website or personal referrals.
By signing up for the Billbooks Affiliate Program (Program), you show your acknowledgment of this Agreement and its terms and conditions.
Acceptance or Rejection of the Application
We reserve the right to accept or reject any Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application. We will review your application and get back to you within 24 to 48 working hours.
Commissions payout will be once between the 1st and th 5th day of every month
You cannot refer yourself as you will not receive a commission for signing up your own accounts. There is also a limit of one commission per referral. If a user clicks your referal link and signs up for multiple accounts, you will be eligible to receive the commission for the first account sign up only.
Affiliate payments will only be made for transactions that have been successfully completed. Transactions resulting in chargebacks or refunds will not be considered, and hence there will be a wait time of 30 days after the first paid registration, to log your commission amount.
The Affiliate application may terminate the participation in the Affiliate Program with immediate effect by giving the other party written notice of termination.
Upon termination, the Affiliate will lose access to its Affiliate Dashboard and will forfeit all potential or unpaid Affiliate Fees.
The program may be terminated for any of the following reasons:
- Fraud or misleading advertisements
- Spamming emails
- Promoting on illegal, unauthorized or prohibited sites
- Violation of intellectual property rights.
- Offering rebates, coupons, or another form of promised kick-backs from your affiliate commission as an incentive.
- Self-referrals, fraudulent transactions, suspected Affiliate fraud.
You cannot SPAM. We will terminate Your Account on the first offense of spamming. Do not send emails to lists or groups that you do not have permission to send them to. We have the right to deactivate or delete Your Account on the first offense referring to this section.
You cannot promote Billbooks on any gambling websites, websites with adult/hate/violent/defamatory content or any other content that is considered offensive or inappropriate, and any websites that violate third-party rights and/or violate any applicable laws. Billbooks may or may not review all content on Your Website(s) or used by you in your promotional methods.
Billbooks may require and you agree to provide us the information regarding traffic sources, promotional channels and your promotional methods with regard to Billbooks Service. If your sources, channels or methods with regard to Billbooks Service would be considered inappropriate or inconsistent with the terms of this Agreement, at Billbooks sole discretion, your account could be suspended, your use privileges could be revoked and Commissions could be canceled.
You may use banners, graphic and text links on your website and also within your email messages, newsletters.
You may use the graphics and text provided by us, or may create your own but according to our terms and requirements.
Coupon and Deal Sites
- Affiliates are not allowed to use misleading text on affiliate links, buttons or images to signify that anything besides currently authorized deals to the specific affiliate.
- Affiliates may not generate pop-ups, pop-unders, iframes, frames, or any other seen or unseen actions that set affiliate cookies unless the user has reflected a clear cut interest in activating specific savings by clicking on a clearly marked link, button or image for that particular coupon or deal. Your link must send the visitor to the merchant site.
- User must be able to see coupon/deal/savings information and details before an affiliate cookie is set (i.e. “click here to see coupons and open a window to merchant site” is NOT allowed).
- Affiliate sites may not have “Click for (or to see) Deal/Coupon” or any variation when there are no coupons or deals available, and the click opens the merchant site or sets a cookie. Affiliates with such text on the merchant landing page will be removed from the program immediately.
Pay Per Click (PPC) Policy
The affiliate may not be allowed to Pay Per Click (PPC) Policy without prior written permission.
Billbooks will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).
We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold by Billbooks We do not guarantee that the operation of the Program and/or our website(s) will be free of errors and we will not be liable for any hitches or errors.
Term of the Agreement
The term of this Agreement begins upon your approval in the Affiliate Program and will stop when your Affiliate account is terminated.
The terms and conditions of this agreement may be altered by us at any time. If any alteration to the terms and conditions of this Agreement are unacceptable to you, your only option is to terminate your Affiliate account. Your continuing participation in the Program will constitute your approval of any change.
Affiliate shall indemnify and hold harmless Billbooks and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by Billbooks from any and all liabilities, fines, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Agreement due to the negligence, misrepresentation, failure to disclose, or intentional offense of Affiliate.
Governing Law, Jurisdiction, and Attorney Fees
This Agreement shall be governed by and construed in accordance with the laws. Any dispute arising under or related in any way to this Agreement shall be adjudicated exclusively in the state courts.
In the event of litigation to enforce any provision of this Agreement, the prevailing party will be entitled to recover from the other party its costs and fees, including reasonable legal fees.
Electronic Signatures Effective
The Agreement is an electronic contract that sets out the legally binding terms of your participation in the Billbooks affiliate program. You indicate your approval of this Agreement and all of the terms and conditions contained or referenced in this Agreement by completing the Billbooks application process. This action creates an electronic signature that has the same legal force and effect as a handwritten signature.
